Army Comrades and I Enjoying Life Off Post on Okinawa

Okinawa 1971, my camera's self-timer allowed me to be in the shot. L -R: that's me wearing bell bottoms; then Colorado mountain country boy John; California biker Earl; and Chris from the upper Midwest. All warriors who could trust each other in combat. That's Chris's chain driven Honda Sports Car, which did not have a radio but the driving sounds while riding in it were music to our young men's ears. We were in front of an off-post house Chris and John rented for $45 a month. The bars on the windows were protection from typhoon blown objects. The house was furnished with old thin Army mattresses for sitting and sleeping, a coffee table, a TV on a stand, nice stereo equipment on stands for the hippie style record album collection, and a spider web painted parachute set up hanging over the living room. The chute was Day-Glo painted psychedelic fashion for the black light they had, plus each room had a regular lamp. Shoes were left outside Japanese style, as those Asians normally do not have chairs or modern beds.

It was a party pad, back in an all-Okinawan neighborhood. In GI housed areas, we'd have been busted for living off post because only married guys with wives there were supposed to be staying off post. Plus, there sometimes was pot smoke smell in and around the place. Many cases of cold beer and bottles of other boozes were enjoyed in that humble abode off-post. We were polite, considerate and not one of us and other friends and buddies - who sometimes partied there - ever got out of hand being drunk in the neighborhood. The Karate trained, average, Okinawan males would have run us out if we had been jerks.

When Okinawans smelled and saw us smoking, they'd smile and say, "Happy smoke, happy smoke," even though no weed was grown on Okinawa - due to the soil not being good for marijuana plants - so it was imported from Southeast Asia. Very few natives had ever tried the dried flowers.

Earl had an apartment where he lived with a cool-chick Okinawan lass who had graduated high school the previous year. Chris had a true-love Okinawan girlfriend who came over on days off school and sometimes with a couple of her female high school friends; a cute one of whom I had hooked up with for a while. John was having an affair with some other GI's wife, and she sometimes came there and got loaded with us. I was with a 20-yr-old Okinawan woman, a bar hostess, for a couple of months, who had smoked cannabis with previous American boyfriends and lived in her own apartment; she was the only local at all with whom we shared pot pipes or joints. Females working in bars hustled drinks and conversed with GIs, but only girls in brothels who possessed health department registration cards were paid sex workers. Most had graduated high school a year or two prior and were working off loans their fathers had made from the brothel mamasan, and that was a shame on the entire society.

For several months, I rented an apartment across a little valley (see photo below) from Chris' and John's place, above the neighborhood convenience store.

We never offered, nor would allow any of our buddies to offer, the Okinawan girls any intoxicants; the girls showed no interest in alcohol or catching a buzz. Delightful young Asian ladies whom we did not wish to change abruptly by them consuming any intoxicants. The Okinawan girls' families were against them being with Americans, so had one gone home high we may have had a serious problem with their fathers. Those girls were not as sophisticated as some of the ones we GIs each knew back home, who had been getting drunk and/or stoned with us since our early teens.

When we were in the store and kids were there, with their parent, we might offer to buy the children each a candy bar after clearing it as OK with the parent and the store owner papasan. In respect of what the parents wanted the children to have in their diets, plus definitely due to fear of diabetes; then also there is the "never take candy from a stranger rule" we were taught while growing up.

One Saturday, when we were at the house with several other buddies, John told us he had promised his Okinawan papasan neighbor that the next time enough of us were around we would remove the remnants of a typhoon toppled tree in his garden that most of it had been sawed off for usable woods. Unfortunately, the wood salvagers had left a huge stump with large roots sticking all out of it higher than our heads. John couldn't stand the sight of that, due to his family living off their garden and not only was the huge stump taking up a lot of space in the small garden - in a crowded suburban neighborhood - the stump shaded some of the plants.

With 7 or 8 young military members together for a friendly physical challenge like that it was, "Yeah man! Let's do it." We got all around the stump then hoisted it up by hand and set it off to the side. Damn we loved that. After that, the usually politely cordial, but Asian society reserved, Okinawan neighborhood who had accepted us there were really happy to exchange greetings when we walked past their homes.

A few months later, I was in the house watching TV with Chris, when John came walking back from somewhere and spoke into the window telling us to come outside. There was an Okinawan family there with the front tire of their car in the small benjo ditch next to the road. Sewage ran from buildings on out to somewhere in often partly open cement trough benjo ditches. The three of us may have been able to lift the small Japanese car ourselves, plus there were two full grown 30-some-yr-old Okinawan men and two women from the trapped auto.

As we three GIs approached the smiling men and two women out around the car making unsuccessful attempts to lift it, John reached his hand out across my and Chris's chests to stop us a second and look in the back seat. There was a 4- or 5-year-old girl in there with her fingers holding closed a deep bloody gash behind her ear. We three smiled with warm feelings of respect and care for the brave child. We appreciated and honored the Asian ways of how they raised their kids to be reserved, calm and collected during all times. We also knew that there was a medical clinic up the road they were heading to. It was a swift lift of the auto by we five men and away the Okinawan family went.

On time, six of us American friends were playing touch football up the road a couple of blocks away on a bare dirt school yard, when some Okinawan kids over on the other side of the schoolyard kicking around a soccer ball got up the nerve to walk over and see what that was we GIs were playing. I was surprised they didn't know what the game of American football is. The oddly oblong ball puzzled them, so we handed it to them and indicated they should show us what to do.

One boy, all were smiling inquisitively friendly, dropped the ball like it was a round soccer ball and they began to pass kick it to each other while laughing wonderfully at how the oblong ball moved zanily as a soccer ball. One of us picked up the pigskin ball as one of us said, "Let's teach them like it was football practice."

We six young American Army men in their home country got them to form two lines, then had them run out for passes. As they got a good grip on what's the deal in catching footballs, we six took turns drawing the lines a receiver would make on a pass catching run. Then every time a kid got it right, we'd dig a coin out of our pockets and reward them. Thier parents made an average of a meager 25 to 35 cents an hour at work and candy bars were one nickel plus sodas a dime, so our coin rewards were welcomed by the boys. We Army dudes drew out the receiver's running patterns to be more complicated to small degrees - just like football practice should be - and it was a whole lotta fun.

Schoolboys on Okinawa were taught Karate at school and by men in their families. It was assumed by GIs that all Okinawan men know some Karate and some are 100% deadly dudes. One hot evening after sunset, 5 or 6 of us friends were out in front of the house and over sitting on the low wall of the neighbor's garden, sipping beers and relaxedly passing a joint. Suddenly, we hear this strange swishing sound coming at us from out of sight just up the road. A group of about 40 young Okinawan men our age were in karate gis jogging barefoot, in tight formation, on the tar surface behind a mature man karate instructor - their sensei. The swishing was due to them not placing their feet in normal running form straight down then up with every step but each step was made by pushing their bare feet down in a forward action across the rough tar surface in order to toughen the soles of their feet.

Us guys knew not to say anything to them, because it could be misconstrued as being rude or actually be rude. Karate is a lot about self-control, and it would have required some seriously aggressive stupidity on our part to anger any of them enough to launch into physical attack against us, but if one or more of them had walked over and insisted, we'd sure enough been convinced to apologize. All told, respect for all Okinawans was a lot more palatable to the friends I had on Okinawa. It allowed us to walk through back street neighborhoods to and from Ft. Sukiran or the shopping, bar, legal brothel and steam bath massage parlor districts any time of day or night.

Late at night, when walking through the neighborhoods, a few times we encountered an Okinawan man sitting cross legged at his front door and skillfully playing a stringed instrument. The men usually wore American style clothing out in public, but the musicians were dressed in their colorful, comfortable, native Asian style. The first time we stopped and smiled appreciatively approvingly, the man got up and went inside. After that we knew it was offensive to be Americans in his country and have us be friendly to a man peacefully playing his beautiful music. After that, on the 2 or 3 other occasions we were blessed to encounter one of those musicians at night, when no vehicles were moving about, and the majority of the residents were asleep in dark homes, we'd walk down the road a ways then stop and listen - in the darkness of backstreets not lit well by street lamps. For brief, magical moments.

Supports That Were Knocked Out From Under The Key Bridge

Barge being pushed under the Key Bridge, into the Port of Baltimore about a dozen years ago. On March 26, 2024, an out-of-control ship hit the Key Bridge right there into the support on the left while floating outbound into this direction. The two supports crumbled and brought the bridge down into the waters:

This is for everyone forever who wants or needs to see exactly what the Francis Scott Key Bridge in Baltimore, Maryland superstructure -  that collapsed - looked like. I had originally made the telephoto image for anyone who's into bridge design, engineering, and construction. For the geometric lines of the skyline beauty. From which artists are invited to use the image to base some of their designs into painting, sculpting, and more. To write a poem to. To add with a short story about the bridge, and we who are deeply affected by its collapse.

I encourage you'z all to share this all over the world.

Evidence Against International Conman John Infantino

Concerning real estate investment fraudster John Infantino: during more than the past decade, for well over 1,000 hours of intense work, I have done online investigations, evidence gathering, writing about the results, and sharing them via emails & website messages to hundreds of appropriate people plus I created numerous internet posts.  I have enough evidence for anyone to know that John David Infantino runs property development & investment scams all over the globe. He once held the developer's lease to Maryland's Fort Howard Veterans Hospital campus, where several times I had been an inpatient veteran. I love the place. Infantino had promised to create a really nice little community there, where vets had first choice on future living quarters. The man never has intention or ability to build anything anywhere. His intent is always to convince investors to be his financial victims.

I possess copies of several of his scam websites, falsified self-promotion online pages, news articles from all over the world, several videos Infantino posted, and it all clearly reveals that John D. Infantino runs devastating con games internationally. I offer to share the entire set of files with any appropriate investigators. It is such a wide, deep & powerful collection of documents that I propose I speak about it and show a solid portion of it at a meeting with investigators, maybe some media, where I can explain to them enough of the evidence to set their minds straight on the sickening facts of the situation. Then they go and do their appropriate investigations to see what they can find out. I have never expected the world to accept what I have to say without professional investigators verifying the facts.

The entire twenty years of the - exponentially worsening  - Ft. Howard VAMC property development tragedy is due to the usual devasting effects that John David inflicts upon severely victimised communities, and ripped off investors all over the world.

Below are screen captures of the thumbnails linked to folders and files of my evidence against John Infantino. The first image, though, is of the Infantino folder properties. You see that it is 29.4 gigs, 6,344 files, and 1,318 folders.

It is shocking to see how many Department of Veterans Affairs properties are listed in these files. Also some active military places, with the most angering to me being a video claiming that Infantino's Federal Development scam did tons of work on the Aberdeen Proving Grounds. A link to watch it is at the bottom of this page.

The most impressively shocking part is all those PDF files!! Some of their names reveal where John David ran or is running scams. To do a little fact-checking, simply web search the name of the PDF along with Infantino. You will not locate any online info of finished and successful anything. No grand openings, ribbon ribbon-cutting ceremonies. No anything saying any development project is a success. Much of what is on the PDFs and other places is lies about projects and properties Infantino never did anything positive for.

A copy of the website JD Realty. JD is John David, which Infantino sometimes uses due to me saying all over anywhere for people to web search John Infantino. An investor who would have lost money to Infantino found some of my online words about Infantino, then told John David I was the one who warned the potential scam victim to not invest. That investor emailed me about the new JD Realty site.

This surely must be a violation of federal laws.
Infantino never did what the video says.

Ft. Howard Project Fakery by John Infantino

Millions of people suffer damages done to their lives by John Infantino, and as he continues to run scam websites declaring his cons to be successful real estate investment endeavors he remains massively relevant. The link here leads to a page where he offers 30 well-crafted, downloadable  PDF files purporting his defunct Bayside at Ft. Howard project to be doing well. At the top of that page are links to many of his current web pages about his non-existent work in the real estate development and investment fields.

John Infantino Scam Websites Today Employ Lies About Ft. Howard

Here we are at fifteen years past the time the VA fired John Infantino from his Ft. Howard VAMC property development lease, and Infantino still uses his fake development project - Bayside at Ft. Howard -  for promoting his investment scams as if Bayside is real and very successful. And as if he does not owe the VA and others millions of dollars due to just that scam. He owes it. As long as John Infantino's scam victims are still suffering from their scammed experiences - as some or all are - plus with Infantino still running scams where he uses Ft. Howard as an example of his successful property development, he is pertinent today. Below are links to where some of the lies are online today:

This link is to 30 fake info PDF files, touting a supposed active veterans' community on Ft Howard, documents which were created and are online to fool investors:

https://grande.property/jdrealty/fort-howard-md-mixed-use/

Here is a quote from Infantino's Bayside Veterans Presentation:

"Bayside at Fort Howard is a retirement community designed especially for U.S. Veterans and their spouses, widows or widowers. The U.S. Department of Veterans Affairs Selected the Fort Howard Senior Housing Associates as the Master Developer for the 93-acre property on the Fort Howard peninsula. Built on the Foundation of a public/private partnership, this is a unique retirement community that will serve as a national model for better serving the needs of our veteran population."

Here is something from one of his Question and Answer pages:

"1. What is Bayside at Fort Howard?

Bayside is a unique life care retirement community offering an active, independent lifestyle in a pleasant environment with access to care for the rest of your life... We offer a one-year renewable lease option in addition to a life care program."

As an upfront payment to live on Ft. Howard till the resident dies, Infantino's "life care program" was set up to take everything a future resident owns. The application - a questionnaire - was offered online, but the applicants had to send a paper check to a post office box. Checks are more difficult to trace than digital transfers of money.

Truth About John Infantino Blog

John David Infantino had the lease to build vets' housing on the Ft. Howard Hospital grounds. I am not the only scam victim (I want to live on the Ft. Howard VA property) of Sociopath Deluxe John Infantino to create online info about him being an international scam artist. Here is something from the blog "The Truth about Federal Development the ugly truth about a Washington D.C. based real estate development firm…"

"Why this website? What about John Infantino? What about Federal Development?

This website was created to assist others in their research about John Infantino and Federal Development – his real estate development company.  If I’d had information like this readily available to me, I might not have gotten involved with Federal Development and could have saved myself considerable time, money and frustration."

John David Infantino never should have been given the Ft. Howard VAMC property lease. The VA made a horrific bad deal when they signed that damned lease. Infantino had already ruined development plans and cheated investors all over the world - INCLUDING THE VA SEVERAL TIMES. John D. also often publishes that all his fake projects are successful, plus he falsely makes claims of being the property and/or asset manager of many properties including VA ones. We need the VA to admit those facts and begin working hard to make amends to us affected parties by facilitating the beginning of development on the VAMC grounds.

Opening and Closing Statements of Infantino vs USA

Here is the opening statement and then the judge's decision of the court case where John Infantino sued the USA saying the VA terminated his lease to Ft Howard illegally. Sociopath Deluxe John D. Infantino completely proved he was 100% in the wrong. He alone is responsible for the Ft. Howard veterans' community development to be a failure. He has done the same to other proposed development all over the world, with many places suffering community tragedy the same as we are. Infantino is the most devastating international foe of all true developers.

FORT HOWARD SENIOR HOUSING ASSOCIATES, LLC,, c/o John D. Infantino, CEO Federal Group International 2300 M Street NW, Suite 800 Washington, DC 20037 (202) 261-2191, Plaintiff, represented by Steven H. Jesser , Steven H. Jesser, Attorney at Law, PC.

USA, Defendant, represented by Sheryl Lynn Floyd , U. S. Department of Justice.

USA, Counter Claimant, represented by Sheryl Lynn Floyd , U. S. Department of Justice - Civil Div..

FORT HOWARD SENIOR HOUSING ASSOCIATES, LLC,, Counter Defendant, represented by Steven H. Jesser , Steven H. Jesser, Attorney at Law, PC.

OPINION

NANCY B. FIRESTONE, District Judge.

Pending before the court is the government's motion for summary judgment, filed pursuant to Rule 56 of the Rules of the United States Court of Federal Claims ("RCFC"). At issue is whether the Department of Veterans Affairs ("VA") properly terminated for default the September 28, 2006 Enhanced-Use Lease ("Lease") between the VA and plaintiff Fort Howard Senior Housing Associates, LLC ("FHSHA") at the Fort Howard VA Medical Center in Baltimore County, Maryland. The Lease was executed pursuant to the VA's authority under 38 U.S.C. §§ 8161-8167 and gave FHSHA the right to occupy the property for a term of 65 years, with an option to extend the Lease for 10 additional years. In exchange for its occupation, FHSHA was required to (1) pay consideration in the form of rent; (2) design, develop and construct a new 10,000 square foot Community-Based Outpatient Clinic ("CBOC") within 39 months; (3) design and construct multi-use residences onsite in compliance with "applicable" state and local laws, codes, and regulations; and (4) protect, preserve, maintain, and repair the property.

After several years, the VA became concerned about the status of the project and, starting in February 2009, the VA began sending notices of default to FHSHA. Ultimately, the VA determined that FHSHA was in default of the Lease and, on August 17, 2009, the VA terminated the Lease for default on the primary grounds that FHSHA had failed to (1) commence construction of the new CBOC such that it would be completed with the timeframe required under the Lease,1 (2) maintain and secure the property, and (3) pay its proportionate share of the utility bills.

FHSHA filed its initial complaint on August 16, 2010 and an amended complaint on June 29, 2012.2 In its complaint, plaintiff asserts that the VA's termination was wrongful on two main grounds: (1) its failure to build the CBOC was excused by the force majeure clause in the Lease, and (2) the government otherwise breached the Lease on various grounds. In its amended answer, the government counterclaimed for breach of the Lease and seeks $313,328.45 as the amount allegedly owed to the government under the Lease.

Here is the determination:

Id. The Termination Notice constituted the designated VA Representative's final decision that the Lease is terminated in its entirety for the following reasons:

1. The defaults identified in the Default Notices constitute a failure to pay Rent, as defined in the Lease. The failure to pay Rent is a material default.

2. FHSHA's failure to maintain the Property and undertake the maintenance required by the Lease at the Property, as described in the Default Notices, are material breaches of the Lease and constitute a failure to pay Rent.

3. FHSHA's failure to secure the Property, as described in Default Notice 2, is a material breach of the Lease and constitutes a failure to pay Rent.

4. FHSHA's failure to maintain insurance on the Property, as described in Default Notice 2, is a material breach of the Lease and constitutes a failure to pay Rent.

5. FHSHA's failure to pay for electrical utilities, as described in Default Notice 1, is a material breach of the Lease.

6. FHSHA has taken no steps to begin the actual development or construction of the Project. FHSHA did not respond to VA's request in Default Notice 2 that FHSHA provide assurances that FHSHA would complete Phase 1 of the Development Plan in accordance with the Lease, including construction and acceptance of the CBOC within thirty-nine (39) months of the Effective Date of the Lease. To date (almost thirty-six (36) months after execution of the Lease), FHSHA has failed to obtain financing for the Project and no lender has been identified and confirmed that it is ready, willing, and able to provide FHSHA the requisite financing to enable FHSHA to construct the CBOC. In addition, no plans have been submitted to VA or the County for review and approval. Further, FHSHA has not started construction of the Project. Accordingly, VA has determined that FHSHA will not be able to meet the deadline of thirty-nine (39) months after the Effective Date of the Lease (December 28, 2009) for construction of the CBOC in accordance with the Lease terms.

Ft. Howard VA Property Zoning Situation

Email sent to Chief, Public & Community Relations at VA Maryland Health Care System R. David Edwards, on 2/21/2024.

This is a community relations situation. We need the proper representatives from the VA to publicly establish the fact that the VA & Baltimore County, along with (fully qualified and experienced) leased developer Sam Himmelrich are not messing around with developing Fort Howard until they are able to build low-income subsidized housing on the former hospital grounds. It is publicly explained as proposed county code/rule/law being designed so that the county can place low-income housing there without rezoning, permits, or with input from council members or the affected United States Citizens. Supposedly, the developer will be able to bypass everything that everyone else has to do to develop housing. That is asinine!!

When the VA fired the 1st lessee (International Super Scammer) John David Infantino from the lease, Infantino declared that he was not legally obligated to follow building codes/rules/laws. Later, he sued the USA (including taxpayers you and me) over it. I have a court report of the case, which states that Infantino was required to follow all codes/rules/laws. Surely that applies to the new developer, also.

Plus, most low-income people will not move there, due to them needing to be close to bus service, stores, etc. It is nearly a 5-mile walk out of the former VAMC to the nearest store; along a two-lane road without sidewalks. Bus service for the area was barely used until it was canceled back in the 1990s.

Numerous people are unreasonable about this. They are asking for support to stop the VA campus from being rezoned from 1 living unit per acre up to 500 living units; relying on the false information that the VA either wants to have low-income Section 8 in there or the residents will be wealthy nonvets. The property sure as hell can be an upscale gated community. I vehemently oppose either type of development.

The greatest fears in the area community are that new housing will become a thriving illegal drug market. They believe some new residents, and drug addicts going there to buy, will be all over the area to steal from sheds, rob vehicles, do burglaries, rape people, get into arguments, start fights, and so forth. I know the community well, from the 1950s up to today. I love Fort Howard and its nearby neighborhoods.

Himmelrich Associates is taking care of the property with grass cutting, fallen tree removal, and full-time security, along with various fixes & upgrades to the infrastructure. They have studied the property and are creating potentially sensible plans for its rebirth to veterans' uses, but cannot commit to proceeding with development work unless they will be able to make enough money to pay for the project.

I cannot recall if I read this or heard it from County Councilman Todd Crandell that the zoning changes were made to be a bargaining point, to bring the numbers of proposed future residents down from the outlandish 1,400 living units that Infantino, then the 2nd not qualified lease signer Tim Munshell had pushed for. Going up to being zoned for several hundred living units is what the situation is about, which may be the only sensible course of action.

The VA created a community nuisance of the VAMC grounds. The place was left unguarded during the Infantino years, plus most of the time Munshell held the lease. Lots of people believe that the place is abandoned, consequently, they feel free to explore, photograph and video (YouTube) all through the broken-into buildings. There have been tons of people "partying" on the grounds.  Some people vandalized buildings for the power feelings of committing destruction. Others stole saleable metals, etc.

Eight arson fires were set, destroying millions of dollars worth of houses, including the most valuable 1900-era homes luxuriously built for Army officers to enjoy living on the shore of the Chesapeake Bay and Patapsco River. There have been at least 60 people locked up for trespassing on federal land. Mostly young men in their 20s, who now have arrest records that might disqualify them from employment, college scholarships, and more. Many of whom were benignly enjoying the place.

Sociopath deluxe John Infantino's development promises led his multitudes of scam victims in steering their lives to soon be living or working at a nicely developed Ft. Howard Veterans Community. I know of two who sold their homes then had to move to lesser places. John David conned many people out of housing deposits, and the State's Attorney ordered the money returned. Has it been repaid?

The VA owes America a written apology for failing to find qualified developers and then allowing the destructive failures, along with waterfront weather rotting buildings, to grow worse for 20 years. Therefore, I declare that the United States Department of Veterans Affairs is obligated to make something positive for veterans and the adjacent communities. AS SOON AS POSSIBLE.

In my mind, the people responsible for the Fort Howard VA property development fiasco are guilty of MANSLAUGHTER! You know full well that if the first developer - International Super Scammer John D. Infantino - had been legitimate and developed the property, it WOULD HAVE BEEN GIVING SOME SUICIDAL VETS SUPPORT & REASON TO LIVE LONGER. That would be vets living there and others who are - RIGHT NOW - DEEPLY DISAPPOINTED, ANGERED AND DEPRESSED FROM KNOWING THE PROJECT HAS BEEN A HORRIBLE FIASCO FOR OVER TWO DECADES. I know these facts from in-person and online communications.

About the States Attorney and Infantino:

https://davidrobertcrews.blogspot.com/2016/05/ft-howard-scam-website-back-online.html

(not on email admin edit 2/22/2024) An excerpt from the court report: Def.'s App'x 44, Article 17.B. Accordingly, if a state or local government imposed taxes on FHSHA's (Fort Howard Senior Housing Associates, LLC) interest in the property, FHSHA was obligated to pay such taxes and the VA did not have the power under § 8167 to exempt FHSHA from paying state or local taxes. ...the court agrees that the Lease required FHSHA to obtain Baltimore County's approval for the development of the property. If FHSHA knew that it would have to construct 1,300 units rather than 550 units to make the Lease viable, FHSHA was required at a minimum to try to get permission from the County to build more than 550 units. The undisputed facts show, however, that FHSHA never sought a variance from Baltimore County. To the contrary, FHSHA decided not to seek a variance, but instead sought only an exemption from local land use rules. See supra n. 15. A request for an exemption is not the same as seeking to comply with local land use requirements through the variance process or otherwise. Because FHSHA bore the risk under the Lease for complying with Baltimore County's density requirements and failed to even attempt to comply with Baltimore County's zoning code, it cannot show that its failure to construct the CBOC (Community-Based Outpatient Clinic) should be excused because it could not finance the project. FHSHA simply failed to fulfill its obligations under the Lease. As such, the court finds that FHSHA's impossibility defense fails as a matter of law.16"

The legal findings for Infantino being legally bound to follow building codes/rules/laws are here:
